US Bureau of Consular Affairs assistant secretary Janice Jacobs has referenced a 20 year plan to improve the US visa system on a recent trip to Australia, addressing concerns that an “inefficient” visa process was limiting tourism to America.

Speaking on the need to improve US Visa services for international visitors to America, Ms Jacobs said “We are trying to be as efficient as we can be.”

She continued “We know that in China, India and Brazil, we are going to need more people and more focus.”

Ms Jacobs also noted that the realisation that tourism to the USA accounts for millions of jobs and billions of dollars of revenue was helping people begin to understand the need to boost the number of tourists to the United States.

However, given the strictness of the new laws introduced after 9/11 to govern entry to the US, Ms Jacobs acknowledged that to “get back some of the discretion I had before that time, I would need to change those laws”.

Ms Jacobs’ comments follow similar remarks made by Amy Klobuchar, Democratic Senator of Minnesota and Chairwoman of the Senate Commerce Subcommittee on Competitiveness, Innovation, and Export Promotion.

Senator Klobuchar spoke out on the need to not take foreign visitors for granted, saying “It doesn’t do much good to promote the U.S. to foreign travellers when those foreign travellers can’t get a visa for months to visit the United States of America.”

Unfortunately for many international travellers, while the ESTA (Electronic System for Travel Authorization) makes the process of applying for entry to the United States relatively quick and easy for citizens of Visa Waiver Program countries, other foreign visitors do not face quite such a simple process.

U.S. Citizenship and Immigration Services (USCIS) will permanently close its field office in Ho Chi Minh City, Vietnam on March 31, 2011, but services previously performed by the U.S. Consulate General will not be affected, the consulate announced this week.

The statement said the U.S. Consulate General would continue, as before, to provide American Citizen Services and Visa Services, including tourist, student, business, and immigrant visas.

The U.S. Consulate General, where authorized, will assume responsibility for processing certain cases formerly processed by the USCIS office in HCMC.

As of March 25, 2011, the U.S. Consulate General will begin to accept I-130 petitions for an immediate relative (spouse, child) from U.S. citizens who have lived uninterrupted and continuously for more than six months in Vietnam and have a valid temporary residency and/or work visa.

Also as of that day, the consulate will begin to accept I-360 petitions from widows of U.S. citizens who do not already have an approved I-130 petition; process requests for relinquishment or abandonment of legal permanent residence status; contact follow-to-join relatives of petitioners in the United States who filed an I-730 petition for them in the U.S., AND for whom that petition has already been approved by USCIS in the U.S., AND whose approved petition has been
forwarded to the U.S. Consulate General by the National Visa Center for interview and processing by the U.S. Consulate General.

Contact legal permanent residents who already applied in the U.S. for a reentry permit, and who indicated on their application (I-131) that that reentry permit be sent to the U.S. Consulate General in order for them to pick it up, the consulate said.

Every Pakistani who wishes to visit India will have to obtain a No Objection Certificate (NoC) from the Ministry of Interior, according to an official statement issued here on Thursday.

The decision was taken in an inter-ministerial meeting to regulate visits abroad of public servants, artists and journalists in the interest of Pakistan’s security and to safeguard the country’s prestige.

Federal Minister for Interior Rehman Malik chaired the meeting. The order will be implemented with effect from March 15 this year. In this regard, the government issued the instructions in consultation with the Ministries of Interior, Foreign Affairs, Culture, Education and Information and Broadcasting.

Turkish Prime Minister Recep Tayyip Erdogan said that visa procedures would be lifted with Malaysia.

Prime Minister Erdogan appeared at a joint news conference after meeting with Malaysian Prime Minister Mohamed Najib bin Abdul Razak and said that they agreed to lift visa procedures between the two countries.

“We are also planning to launch direct flights between Istanbul’s Sabiha Gokcen airport and Kuala Lumpur,” he said.

Erdogan said that Abdul Razak was the first Malaysian prime minister paying a state visit to Turkey in 28 years.

“We will sign a free trade agreement between Turkey and Malaysia this year. Such an agreement will add momentum to our economic and commercial relations. Currently, our trade volume is about 1.2 billion USD. We can increase it up to 5 billion USD. We are going to attend Turkey-Malaysia Business Forum in Istanbul tomorrow. We will tell our businessmen that we are ready to extend full support to mutual investments. Our businessmen can also work together in the third countries,” he said.

Malaysian Prime Minister Abdul Razak, on his part, said that he invited Prime Minister Erdogan to Malaysia by the end of 2011 to sign strategic cooperation agreement and free trade agreement.

“These two agreements will mark beginning of a new era in Turkey-Malaysia relations. There will be no more visa procedures between our countries,” he said.

He added that Turkey and Malaysia could develop an exciting cooperation in oil and natural gas.

Following the press conference, Prime Minister Erdogan hosted a banquet in honor of his Malaysian counterpart.

Visa-free travel between Russia and the EU will top the agenda of  Thursday’s meeting  in Brussels between members of the Russian government and representatives of the  European Commission.

Speaking in Kaliningrad on Wednesday PM Vladimir Putin said much attention would be paid to lifting visa restrictions between Russia’s westernmost exclave and the neighboring EU countries.

Poland has already given a nod to the idea and Russia is currently discussing the matter with other European nations.

France has set up two visa sections at its consulates in Bangalore and Kolkata from where one can also get Schengen visa that enables travel to certain European countries.

While the visa office in Bangalore became operational yesterday, the one in Kolkata will start issuing visas and business permits from the end of this week.

“The move is to provide better visa services to the people of the country. The new centers will reduce the burden of the people to travel to far away places to get their visa,” French Embassy officials said here today.

Schengen visa enables one to travel to certain European countries even if he has secured the visa from one particular country.

This will enable travelers from Karnataka and Andhra Pradesh to get the visas from the Bangalore office. Till now, they had to go to Mumbai to get one.

Officials of the ‘Invest in France Agency’ said the French government had recently decided to 10-year residency permit for exceptional economic contributions to the country.

The EU understands the need for abolition of visa regime with Russia, but is awaiting reciprocal steps from Moscow.

This was announced at a press conference in Kaliningrad (Western Russia) by the Chairman of the Foreign Affairs Committee of the German Bundestag Ruprecht Polenz, who is taking part in the ongoing first trilateral meeting of parliamentarians- international affairs experts from Russia, Poland and Germany.

Head of the Russian State Duma International Committee Konstantin Kosachev noted that the MPs are unanimous on the issue of visa-free regime between Kaliningrad and the neighboring provinces of Poland.

However, in practice it all hinges on the internal regulations of the European Union, Kosachev said, stressing that on the part of Russia there were no problems.

Governments in Europe and throughout the world must begin to abolish visa regimes, according to a top European human rights official.

“The trend in Europe and the world as a whole should go toward abolishing visa requirements because there is one principle of human rights, namely the freedom of movement, which is prevented, sometimes as a consequence of visa regulation,” Thomas Hammarberg, the Council of Europe’s commissioner for human rights, told the Hürriyet Daily News & Economic Review on Friday.

Although it is quite difficult to challenge visa regimes from a human rights point of view because states have the right to control their borders and decide who enters the country, Hammarberg said the Council of Europe had a general desire to lift visa requirements around the world.

Hammarberg made the comments at the end of a seminar in Istanbul last week on the human rights dimensions of migration in Europe.

Speaking Thursday at the seminar, Turkish Interior Ministry Deputy Undersecretary Zekeriya Şarbak said the implementation of visa regimes was inconsistent with community rights. “It is unjust and unlawful. … We hope the [visa regime with EU countries] will be removed as soon as possible.”

The British government has toughened work visa requirements for jobseekers outside the European Union, doing away with the provision for them to settle in the UK.

The British Home Office on February 16 unveiled the details of the UK government’s reforms in work visa route. The shake-up is part of the new annual limit on non-EU workers, which will take effect on April 6, says a statement of the British High Commission in Dhaka.

“Britain needs to attract the brightest and the best to fill jobs gaps, but this should never be at the expense of workers already here. We have made it clear that employers should look first to people, who are out of work, and who are already in this country,” said UK Immigration Minister Damian Green.

“We intend to make the route to settlement tougher. It cannot be right that people coming to fill temporary skills gaps have open access to permanent settlement,” said Damian.

The non-EU workers, who want to go to Britain, will need to have a graduate level job, speak an intermediate level of English, and meet specific salary and employment requirements.

At the end of last year, the British government announced that nearly 20,700 visas will be made available in 2011-12 to skilled workers applying through Tier 2 of the Points Based System, as well as 1,000 visas under a new Exceptional Talent route.

Under the new system, employers will have to apply for a Certificate of Sponsorship (CoS) from the UK Border Agency for a specific post if they wish to bring someone to the UK; a change from the current system that gives businesses an annual allocation.

The UK also announced that employers, who wish to fill a vacancy with a salary of £150,000 or more will not be subject to the limit on the number of CoSs that may be allocated.

The annual limit of 20,700 CoSs will be divided into 12 monthly allocations. At least 4,200 CoSs will be made available in April considering the possible demand in the first month of implementation. After that, the limit will be set at 1,500 places a month. Any places that are unused each month will be rolled over to the following month.

The Intra Company Transfer route, which is not part of the annual limit, will also be changed in three ways: the job will have to be in an occupation on the graduate occupation list, only those workers paid £40,000 or more will be able to stay for more than a year, and workers paid between £24,000 and £40,000 will be allowed to stay in the UK for no longer than 12 months.

Immigration staff are failing to take action against hundreds of migrant workers who have no right to stay in Britain, a critical report has found.

John Vine, an independent chief inspector of the UK Border Agency, said the visas of migrants whose jobs had ended were not being cancelled.

He also found insufficient checks were being carried out on companies which sponsor overseas workers.

Immigration minister Damian Green said the system was being improved.

The report comes as the government announced non-European Union workers earning more than £150,000 a year and some scientists were to be excluded from the government’s immigration cap.

Mr Green said the UK had to attract the brightest and the best to promote recovery.

Mr Vine’s report examined the government’s points-based system for skilled workers who want to come to the UK.

It found there were 150 cases where the visas of migrants who had finished jobs and were required to leave the UK were not cancelled.

And there were likely to be many more because of a backlog of 3,000 potential cases as yet unprocessed, it added.

Mr Vine said he was concerned the agency was not visiting the firms who hire or sponsor migrant staff.

He told the BBC: “The Border Agency needs to do the appropriate checks on the sponsor, and satisfy itself of course that they are a bona fide employer and that their employment exists.

“And that’s why I was concerned about the visit to the premises not having been carried out in all cases.”

His report also found inconsistent approaches to decision-making, with some applicants refused because of minor omissions, and others given extra time to supply the missing information.

The agency had put profits before securing the UK’s borders with an emphasis “always on income-generating work first”, Mr Vine added.

And he called for the agency to act promptly to return those living in the UK illegally.

“If people no longer qualify to stay in the UK according to their visa conditions, then they must be required to leave the country,” he said.

“Many staff perceived that quality of decision-making and controlling immigration were not as much of a priority for the UK Border Agency as generating income and providing customer service.”

‘Making it worse’

Shadow immigration minister Gerry Sutcliffe said ministers were cutting 5,200 jobs at the agency at the “very time we need to improve enforcement and tackle illegal immigration.

“As the independent chief inspector’s report today makes clear, UKBA faces a resources challenge and the government is intent on making it worse,” he said.

Immigration minister Mr Green agreed changes needed to be made to ensure the system was effective.

He said: “We do regulate sponsors properly, but obviously I’m very interested in what the chief inspector has to say and, if we do need to improve the UKBA systems, we will do so.”

He said communication among agency staff and the IT systems had been improved to ensure the system was moving “in the right direction”.
